Our Commitment

Kernelis Studio, LLC ("Kernelis Studio," "we," "us," or "our") is built on the principles of grace and love, and on the belief that opportunity should be open to everyone. We are committed to fostering a workplace, client relationship, and community free from discrimination and harassment of any kind.

We provide equal opportunity in all aspects of employment and business, including recruitment, hiring, training, compensation, promotion, assignment of work, discipline, termination, and access to our services. All decisions are made on the basis of qualifications, merit, and business needs.

This policy applies to all employees, applicants, contractors, interns, vendors, clients, and anyone else who interacts with Kernelis Studio.

Anti-Discrimination

Kernelis Studio does not discriminate against, harass, or take any adverse action against any person on the basis of any category protected under the laws of the Commonwealth of Puerto Rico and applicable federal law. Protected categories include, but are not limited to:

  • Sex, including pregnancy, childbirth, and related conditions
  • Sexual orientation and gender identity
  • Social or national origin
  • Social condition
  • Marital status
  • Political affiliation or political beliefs
  • Religious beliefs or creed

This commitment is grounded in Puerto Rico's anti-discrimination framework, including Act No. 100 of June 30, 1959 (General Anti-Discrimination Act), as amended; Act No. 69 of July 6, 1985 (Sex Discrimination Act); Act No. 44 of July 2, 1985 (Disability Discrimination Act); Act No. 3 of March 13, 1942 (Working Mothers Protection Act); Act No. 17 of April 22, 1988 (Sexual Harassment in Employment Act), as amended; Act No. 16 of March 8, 2017 (Equal Pay Act); and applicable federal statutes including Title VII of the Civil Rights Act, the Americans with Disabilities Act, and the Age Discrimination in Employment Act.

Anti-Harassment and Sexual Harassment

Kernelis Studio maintains a zero-tolerance stance toward harassment based on any protected category. This includes sexual harassment, which encompasses unwelcome sexual advances, requests for sexual favors, and any verbal, physical, or visual conduct of a sexual nature that affects the terms or conditions of a person's engagement with us or creates an intimidating, hostile, or offensive environment.

Consistent with Act No. 17 of 1988, as amended by Act No. 82 of 2022, our protections extend to employees, interns, contractors, clients, and visitors. We are committed to preventing harassment, addressing complaints promptly, and protecting all parties throughout the process.

Equal Pay

In accordance with the Puerto Rico Equal Pay Act (Act No. 16 of 2017), Kernelis Studio provides equal pay for equal work regardless of sex or any other protected category. We do not request prior salary history as a condition of employment and we support the right of employees to discuss and inquire about compensation.

Reasonable Accommodation

Kernelis Studio provides reasonable accommodations to qualified individuals with disabilities who can perform the essential functions of their role, and to employees who are victims of domestic violence, stalking, or sexual aggression, consistent with Act No. 44 of 1985 and Act No. 100, as amended. Anti-Retaliation

Kernelis Studio strictly prohibits retaliation against any person who, in good faith, reports discrimination or harassment, files a complaint, opposes a discriminatory practice, participates in an investigation, or serves as a witness. Retaliation is itself a violation of this policy and of Puerto Rico law, and will be treated with the same seriousness as the underlying conduct.

How to Report a Concern

If you experience or witness conduct that may violate this policy, we encourage you to report it promptly. You do not need to be certain a violation occurred to raise a concern.

Step 1 — Report.
Submit your concern by email to [email protected].

Please include, where possible, a description of what happened, the people involved, dates and locations, and the names of any witnesses. Reports may be submitted in English or Spanish.

Step 2 — Acknowledgment.
We will acknowledge receipt of your report and, where appropriate, request any additional information needed to proceed.

Step 3 — Investigation.
We will conduct a prompt, impartial, and confidential investigation to the extent reasonably possible. Confidentiality will be maintained consistent with the need to investigate thoroughly and take corrective action.

Step 4 — Resolution.
Upon completing the investigation, we will take appropriate corrective action where a violation is found. We will communicate the outcome to the reporting party to the extent permitted.

Step 5 — Protection.
At every stage, we protect reporting parties, witnesses, and participants from retaliation.

External Reporting Options

You always retain the right to file a complaint directly with a government agency. These include:

  • Puerto Rico Department of Labor and Human Resources (DTRH), Anti-Discrimination Unit (Unidad Antidiscrimen)
  • U.S. Equal Employment Opportunity Commission (EEOC)

Statutory deadlines apply to external filings, so we encourage prompt action if you choose this route.

Responsibility and Enforcement

All Kernelis Studio personnel share responsibility for upholding this policy. Leadership is responsible for its enforcement, for responding to concerns without delay, and for ensuring this policy remains current with applicable law. Violations may result in disciplinary action up to and including termination of employment or engagement.
